As a public service and as a service to our readers, the Gazette today filed an Open Records Request under the Texas Public Information Act with the Terlingua Common School District.

The Gazette is seeking documents pertaining to a mutual fund formally known as the Lone Star LiquidityPlus Fund and now called the Government Overnight Fund. According to the fund manager, First Access LLC, the fund changed names in 2009 and became the Government Overnight Fund. The Terlingua CSD still reports the old name of the investment.

The Gazette is also requesting the audited Financial Report of the school for the last eight years. This information is usually found on school websites and is not reported on the Terlingua CSD website.

Here is a copy of the request sent today to school Superintendent Bobbie Jones:

Dear Officer for Public Records:
This request is made under the Texas Public Information Act, Chapter 552, Texas Government Code, which guarantees the public’s access to information in the custody of governmental agencies. I respectfully request the following information:
1. All financial statements from the Lone Star Liquidity Investment Pool, and or, First Access LLC, and or the Government Overnight Fund and or the Corporate Overnight Fund from January 1, 2004 to present.
To assist in the search, please note that according to First Access LLC, the Lone Star Liquidity Plus Fund underwent a name change in 2009 and became the Government Overnight Fund.
2. Financial Report of TERLINGUA COMMON SCHOOL DISTRICT, Terlingua Texas for year ended 2012, 2011, 2010, 2009, 2008, 2007, 2006, 2005.
The information in the next paragraph was originally requested in an Open Records Request Dated April 28. On May 1, in a letter you responded to this request and stated that 57 pages of documents were available. I am again making a request for these documents.
3. The names of all contractors, subcontractors, consultants and consulting firms who have done or are doing business with the Terlingua Common School District between January 1 2009 and present and the amounts paid to such entities. This request includes
contracts executed for said parties who have been retained and not yet paid.
In the interest of expediency, and to minimize the research and/or duplication burden on your staff, I would be pleased to personally examine the relevant records if you would grant me immediate access to the requested material. Additionally, and since time is a factor, please communicate with me by telephone or email rather than by mail. My telephone number is 432-837-5755 and my email address is [email protected].
Disclosure of this information is in the public interest because providing a copy of the information primarily benefits the general public. I therefore request a waiver of all fees and charges pursuant to Section 552.267 of the act.
I shall look forward to hearing from you promptly, as specified in the law. Thank you for your cooperation.
John Waters
